These Terms govern access to https://lolitaovia.com and purchases from Lolitaovia. The store is operated by Sporty Casual Inc, registration number 6491198, at 3154 Glendale Blvd, Suite 1097L, Los Angeles, CA 90039, United States.

By using the website or placing an order, a customer agrees to these Terms and the policies referred to in them, subject to applicable law.

Definitions and Policy Structure

Lolitaovia, we, us, and our refer to Sporty Casual Inc operating the Lolitaovia store. Customer and you refer to a visitor, account holder, or purchaser. Website and store refer to https://lolitaovia.com. Product means a physical item offered for purchase. Order means a purchase request submitted through checkout.

The product page and checkout provide item-specific information and the final purchase total. The Shipping Policy governs processing, shipping, carriers, duties, tracking, and delivery exceptions. The Return and Refund Policy governs cancellations, returns, exchanges, and refunds. The Payment Methods and Secure Payment Policy govern payment. The Privacy Policy, Cookie Policy, and Your Privacy Choices govern personal information. Where a short summary omits detail, the applicable detailed policy supplies those additional terms. All summaries and detailed policies are intended to be consistent, subject always to mandatory law.

Eligibility and Customer Information

Customers must be legally able to enter into a purchase contract in their jurisdiction. A customer who has not reached the age of majority where they live may use the store and enter into a purchase only with the involvement and consent of a parent or legal guardian. Customers are responsible for providing accurate account, billing, contact, and shipping information and for protecting their account credentials.

Customers must promptly update information that changes before fulfillment. We do not ship to PO boxes or military addresses. A customer who uses an account must take reasonable steps to prevent unauthorized access and should contact us if the account or order information appears to have been used without permission.

The store is intended for personal retail purchases. A customer must not use false information, impersonate another person, submit an unauthorized payment method, interfere with fraud controls, or place an order for an unlawful purpose.

Product Information

We aim to describe products accurately. Product availability, variants, measurements, materials, included components, and care information may vary and are shown on the applicable product page. Colors and appearance can vary by screen and display settings. Contact us before ordering if an important detail is unclear.

The customer is responsible for reviewing the product title, description, photographs, price, selected size, color and other variant, included components, and measurements before checkout. A styling photograph may show accessories or other products that are not included; the product description and selected variant determine what is ordered.

We do not promise that every product will remain available. Adding a product to a cart does not reserve it. If an item becomes unavailable after payment, Lolitaovia will notify the customer no later than 3 calendar days after payment. The customer may choose to wait for restocking or receive a refund. We will not substitute another product, size, color, or variant without the customer’s agreement.

Prices and Currency

Our base and settlement currency is USD. Customers may see prices and complete checkout in a supported local currency. The currency and final total shown at checkout apply to the order.

Prices, promotions, and availability may change before an order is submitted. We may correct genuine typographical, pricing, or availability errors, subject to applicable law, and will notify an affected customer when required.

Product prices are tax-inclusive. Before payment authorization, checkout shows the product subtotal, applicable discounts, applicable shipping charge, currency, and final total; it does not add a separate tax charge. Orders with a discounted merchandise subtotal of at least USD $69.99 qualify for free shipping; Standard Shipping is USD $12.99 below that threshold. A customer’s bank or payment provider may separately apply charges under its own agreement.

Orders

Submitting an order sends us a request to purchase the selected products. Lolitaovia accepts the order when payment succeeds and the order confirmation email is issued. We may nevertheless cancel an accepted order for a legitimate reason such as suspected fraud, a shipping restriction, or a material pricing error, subject to applicable law. If payment has been collected for an order we cancel before shipment, we will initiate a full refund to the original payment method within 7 business days after confirming the cancellation. The customer’s bank, card issuer, or payment provider may require up to an additional 7 business days to post the refund. Post-payment inventory unavailability is handled through the customer-choice process described above.

An order confirmation records the information submitted through checkout. Customers should review it promptly and contact help@lolitaovia.com before shipment if the shipping address, size, or color is incorrect. We will try to make a requested pre-shipment change, but it is not guaranteed once processing has begun.

We will not substitute a different product, size, or color without the customer’s agreement. We may contact the customer through the email address or telephone number supplied at checkout when information needed to process the order is missing or appears inconsistent.

Payment

Payments are processed through Shopify Payments. The store is configured to support Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, Discover, UnionPay, and Diners Club. Availability depends on the customer’s location, device, currency, eligibility, and the methods displayed during live checkout. PayPal is not accepted. Additional details appear in the Payment Methods and Secure Payment Policy pages.

Submitting a payment authorizes the transaction to be processed through Shopify Payments and the selected method. A payment provider may decline or review a transaction. A pending authorization does not by itself mean that a separate order was accepted. Customers should use the Payment Methods process for a failed, pending, unfamiliar, or duplicate payment.

Shipping

Orders ship from the United States. Processing time, transit estimates, shipping charges, destinations, customs treatment, and tracking are governed by the Shipping Policy. Delivery dates are estimates and are not guaranteed.

The customer is responsible for a complete deliverable address, monitoring shipping communications, and reasonably cooperating with carrier delivery. Lolitaovia is responsible for processing accepted orders under the published policy, using an applicable carrier, providing a tracking number for every shipment, and reviewing reported delivery issues. Customs duties and import taxes covered by the Shipping Policy are paid by Lolitaovia.

If the carrier confirms that a package was lost or delivered to the wrong location, the customer may choose either a free replacement or a refund for the affected product or products. Lolitaovia hands an approved replacement to the carrier within 3 business days or initiates the selected refund within 7 business days after confirmation. The refund amount follows the affected-item and entire-order rules in the Shipping Policy and Return and Refund Policy. An item that arrives damaged is handled under the 30-calendar-day product quality process in the Return and Refund Policy.

Returns, Exchanges, and Refunds

Eligibility, request deadlines, return costs, exchanges, cancellations, and refund timing are governed by the Return and Refund Policy. Nothing in these Terms limits non-waivable consumer rights.

For clarity, a product quality problem, incorrect item, or transit-damaged item must be reported within 30 calendar days after delivery. A size exchange must be requested within 2 calendar days and meet the stated condition requirements. Voluntary returns for change of mind, color, or style are generally not accepted, while the United Kingdom statutory cancellation right and other mandatory rights remain applicable.

Approved returns must be sent only to the United States return warehouse address supplied by customer service. The business address and the address on an original parcel must not be used as a return address.

Cancellations and Order Changes

Before shipment, customers may request cancellation or a change to the shipping address, size, or color. A request is effective only after Lolitaovia confirms it in writing. Approved pre-shipment cancellations receive a full refund to the original payment method, initiated within 7 business days after confirmation, with no cancellation fee. The customer’s bank, card issuer, or payment provider may require up to an additional 7 business days to post the refund.

Promotions

Discounts and promotions are subject to the conditions displayed with the applicable offer. A promotion applies only while it is valid and only to eligible products or orders. Unless the offer states otherwise, promotions cannot be exchanged for cash.

Sale and promotional items follow the same Return and Refund Policy as regularly priced items and are not automatically final sale. A refunded amount is based on the amount actually paid after the applicable discount.

Reviews and Customer Content

Customers must submit only content they have the right to share. Reviews or other submissions must not be unlawful, deceptive, abusive, infringing, or contain another person’s sensitive information. Content may be moderated as permitted by applicable law and the terms presented when it is submitted.

A review should describe a genuine experience with the relevant product or service. We may act on spam, impersonation, threats, unlawful material, undisclosed conflicts, personal data, or intellectual property concerns. Moderation must not be used to misrepresent the overall customer experience or suppress a review merely because it is unfavorable.

Intellectual Property

Website content and brand assets are protected to the extent owned by or licensed to Sporty Casual Inc. Permitted and prohibited uses and the reporting process are described in the Intellectual Property Policy.

Prohibited Uses

Customers may not misuse the website, interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or exploit content unlawfully, submit unlawful or harmful material, or use the service in violation of applicable law.

Customers also may not circumvent purchase limits or security controls, submit fraudulent claims, misuse another person’s payment or identity information, collect personal information from the website without authority, or use Lolitaovia branding to imply a false affiliation.

We may restrict access, decline an order, preserve relevant records, or take another proportionate step when reasonably necessary to protect customers, the store, service providers, or legal rights. Such action remains subject to applicable law and does not remove an accrued refund or consumer right.

Third-party Services and Links

The store uses or links to third-party services, including Shopify and services that support payments, fulfillment, shipping, tracking, communications, and other store functions. Third-party terms and privacy practices may apply separately.

A link does not by itself mean Lolitaovia controls or endorses a third-party website. Customers should review a third party’s applicable terms before using its independent service. Lolitaovia remains responsible for its own obligations as the seller and does not use a third-party service to avoid a responsibility that applicable law places on us.

Availability and Liability

We do not guarantee that the website will always be uninterrupted or error-free. To the fullest extent permitted by applicable law, liability is limited to losses that are a reasonably foreseeable result of our breach. Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Customers are responsible for taking reasonable steps to limit avoidable loss and for providing accurate information needed to resolve an order issue. We are not responsible for a failure caused solely by information the customer supplied incorrectly or by an event outside our reasonable control, except to the extent applicable law places responsibility on us.

Applicable Law

These Terms are governed by applicable law. Customers retain any mandatory consumer protections available in the place where they live. A dispute may be brought before a court or authority that has jurisdiction under applicable law.

No wording in these Terms requires a customer to waive a non-waivable right, accept an undisclosed arbitration process, or bring a claim in a location where applicable law permits another competent forum.

Complaints and Resolution

Customers should send a complaint to help@lolitaovia.com or through https://lolitaovia.com/pages/contact. Include the order number or page URL, a clear description of the issue, the outcome requested, and relevant non-sensitive supporting information.

We will record and review the complaint, check the available order, payment, fulfillment, tracking, communication, return, and refund information, request clarification when reasonably needed, and communicate the outcome or next step. The detailed complaint path appears in the Legal Notice. Using it does not prevent a customer from exercising a regulator, payment-dispute, court, or other right available under applicable law.

Changes to These Terms

We may update these Terms to reflect changes in our store practices, services, or legal obligations. The date at the top identifies the current version. Changes apply prospectively unless applicable law requires otherwise.
